Portura Terms of Service

Quick summary (not a substitute for the full terms): Portura helps you create and share a professional portfolio and includes AI-powered features. You keep ownership of your content; you grant us a license to host and display it. Some parts of the service are paid (plans/tokens). Please use Portura lawfully and responsibly. These terms include important limitations of liability and dispute provisions.


1. Agreement to Terms

By creating an account, signing in (including via Google, GitHub, LinkedIn, or any other provider), or using any part of Portura’s websites, apps, or services (collectively, the Service), you agree to these Terms of Service (Terms). If you do not agree, do not use the Service.

We may update these Terms from time to time. We will post the updated Terms and indicate the Effective Date above. Your continued use of the Service after changes become effective constitutes acceptance.

If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms and “you” refers to that organization.

2. Who We Are

These Terms are between you and Portura, which is currently operated by an individual (sole proprietor) doing business as Portura (“portura.ai, Portura,” “we,” “us,” or “our”).

3. Eligibility & Accounts

  • You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) and able to form a binding contract. If you are under 18, you represent you have parental/guardian consent.
  • You must provide accurate information and keep your account information up to date.
  • You may authenticate with third-party identity providers (e.g., Google, GitHub, LinkedIn). We may require email verification before granting full access.
  • You are responsible for safeguarding your account and for all activities under it. Notify us immediately of any unauthorized use.
  • We may refuse, suspend, or terminate accounts at our discretion as permitted by law.

4. Plans, Billing, Tokens & Renewals

Some features require a paid membership plan or usage tokens.

  • Plans & Billing. Plan details (including price, features, quotas) are shown at purchase. Payments are processed by third parties (e.g., Stripe). You authorize us and our payment processor to charge your payment method for fees and taxes.
  • Tokens. Tokens are a usage metric (not a currency) consumed by certain features (e.g., AI). Plans may include periodic token grants and/or allow one-off purchases. Tokens are non-transferable and non-refundable except where required by law. Unused monthly tokens may reset as indicated in your plan.
  • Changes. We may modify plan pricing/features prospectively. We will provide notice as required by law.
  • Refunds. Except where required by law, fees and tokens are non-refundable.

5. Portura & AI Features

Portura may include AI-assisted features (e.g., generating bios, summaries, or suggestions). By using these features:

  • You understand AI outputs may be incorrect, incomplete, or infringing; review and verify outputs before relying on them.
  • You grant Portura the rights necessary to process your prompts, inputs, and content to provide the Service and to operate, maintain, secure, and improve it.
  • Subject to these Terms, you may use AI outputs for your own purposes, but you are responsible for ensuring your use complies with applicable law and third-party rights.
  • Do not input confidential or highly sensitive personal information that you are not authorized to process.

6. Your Content & Licenses

Your Content includes portfolio elements (text, images, projects, links), profile information (name, avatar), and other materials you upload or submit.

  • Ownership. You retain ownership of Your Content.
  • License to Portura. You grant Portura a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (for formatting/display), publicly perform, publicly display, and distribute Your Content as reasonably necessary to operate and provide the Service and to show your public portfolio at your direction.
  • Public Portfolios. You control whether your portfolio is public or private via settings. Public content may be indexed by search engines and cached by third parties. Removing or making content private does not guarantee instant removal from caches or archives.
  • Feedback. If you provide feedback or suggestions, you grant Portura a perpetual, irrevocable, worldwide, royalty-free license to use them without obligation to you.
  • Representations. You represent and warrant that you have all rights needed to license and share Your Content and that it does not violate law or third-party rights.

7. Acceptable Use

You agree not to:

  • use the Service in a way that violates law, infringes intellectual property, invades privacy, or is harmful, deceptive, or abusive;
  • upload malware, attempt to gain unauthorized access, interfere with the Service, or bypass usage limits or fees;
  • send spam, run unsolicited promotions, or misrepresent your identity;
  • scrape or reproduce the Service except as permitted by these Terms or applicable law;
  • use AI features to generate or disseminate illegal, harmful, or misleading content.

We may remove content or suspend/terminate access for violations.

8. Third-Party Services

Portura integrates with third parties such as Cloudinary (media storage/transformations), Stripe (payments), authentication providers (Google, GitHub, LinkedIn), email providers (e.g., Resend), analytics, and others. Your use of those services may be subject to their terms and privacy policies. Portura is not responsible for third-party services and does not control their availability or performance.

9. Privacy

Please review our Privacy Policy to understand how we collect, use, and share information. We may collect data such as your name, email, profile data, portfolio content, IP address (for security/fraud prevention), and usage metrics to provide and improve the Service. Where required, we will seek your consent for marketing communications; you can opt out at any time.

10. Intellectual Property

The Service, including software, designs, and trademarks, is owned by Portura or its licensors and is protected by intellectual property laws. Except for the rights expressly granted in these Terms, we reserve all rights. You may not reverse engineer, decompile, or create derivative works of the Service except to the extent permitted by law.

11. Suspension & Termination

We may suspend or terminate your access for any violation of these Terms or as required by law. You may stop using the Service at any time and request account deletion. Upon termination, rights and obligations that by their nature should survive (e.g., fees owed, indemnities, limitations of liability) will survive.

12. Disclaimers

THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, PORTURA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected. AI outputs may be inaccurate or inappropriate; you are responsible for your use of outputs.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PORTURA AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO PORTURA IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY OR (B) USD $100.

Some jurisdictions do not allow certain limitations; in those cases, the above limitations will apply to the maximum extent permitted by law.

14. Indemnification

You will defend, indemnify, and hold harmless Portura and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to Your Content, your use of the Service, or your violation of these Terms or applicable law.

15. DMCA & Copyright Complaints

If you believe content on the Service infringes your copyright, please send a notice to our designated agent:

Your notice should include:

  • identification of the copyrighted work and the allegedly infringing material;
  • contact information for the complaining party;
  • a statement of good-faith belief that use is not authorized; and
  • a statement under penalty of perjury that the information is accurate and you are authorized to act.

We may remove material and, where appropriate, terminate repeat infringers.

16. Export & Sanctions

You must comply with applicable export control and sanctions laws. You may not use the Service if you are located in, or are a resident of, a country or region embargoed by the U.S., or if you are on a restricted party list.

17. Governing Law; Venue

These Terms are governed by the laws of the State of California, without regard to its conflict of laws rules. Any dispute arising out of or relating to these Terms or the Service will be resolved in the state or federal courts located in Los Angeles County, California (closest major venue to Burbank), and you consent to jurisdiction there. Either party may seek injunctive relief in any court of competent jurisdiction. (Nothing in this section prevents either party from seeking relief in small claims court where appropriate.)

18. Changes to the Service

We may add, change, or discontinue features or the entire Service at any time. If we discontinue the Service, we will make reasonable efforts to provide advance notice and, where applicable, a pro-rata refund for prepaid fees for unused periods as required by law.

19. Miscellaneous

  • Entire Agreement. These Terms, along with any order forms and the Privacy Policy, are the entire agreement between you and Portura.
  • Severability. If any provision is unenforceable, the remaining provisions will remain in effect.
  • Assignment. You may not assign these Terms without our consent; we may assign them as part of a merger, acquisition, or asset sale.
  • No Waiver. Our failure to enforce any provision is not a waiver.
  • Notices. We may provide notices via email, in-app messages, or by posting on the Service.
  • Beta Features. Features marked “beta” or “preview” are provided as-is and may be modified or discontinued at any time.
